1. Electronic Record & Digital Agreement

This document is an electronic record in terms of the Information Technology Act, 2000 and rules thereunder as applicable, and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

2. Regulatory Compliance

This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries Guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy, and Terms of Use for access or usage of the domain name https://roksho.store/ (hereinafter referred to as the "Website"), including the related mobile site and mobile application (collectively referred to as the "Platform").

 

3. Corporate Identity & Platform Ownership

The Platform is owned and operated by roKsho.inc, a corporate entity operating under the laws of India (hereinafter referred to as the "Platform Owner", "we", "us", or "our").

4. Acceptance and Binding Nature of Terms

Your use of the Platform, services, and digital tools is governed strictly by the following terms and conditions (“Terms of Use”) as applicable to the Platform, including all applicable policies which are incorporated herein by way of reference. If you transact on the Platform, you shall be subject to the policies that are applicable to the Platform for such transactions. By the mere use of the Platform, you are contracting with the Platform Owner, and these terms and conditions—including all policies—constitute your binding legal obligations with the Platform Owner.

These Terms of Use relate to your use of our Website, goods (as applicable), or services (collectively, "Services"). Any terms and conditions proposed by you which are in addition to or which conflict with these Terms of Use are expressly rejected by the Platform Owner and shall be of no force or effect. Account Integrity: To access and use our Services, you agree to provide true, accurate, and complete information to us during and after registration, and you shall be held exclusively responsible for all acts and financial transactions executed through the use of your registered account on the Platform.

  2. Warranty Limitations: Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness, or suitability of the information and materials offered on this website or through the Services for any specific purpose. You acknowledge that such information and materials may contain technical inaccuracies or clerical errors, and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

     

  3. Independent Assessment: Your use of our Services and the Platform is solely and entirely at your own risk and discretion, for which we shall not be liable to you in any manner. You are required to independently assess and ensure that the clothing items, sizes, or custom services meet your specific criteria before purchasing.

  4. Proprietary Intellectual Property: The contents of the Platform and the Services are strictly proprietary to us or are licensed to us. You will not have any authority to claim any intellectual property rights, title, or interest in its contents. This protected material includes, but is not limited to, the core brand assets, apparel designs, layouts, visual look, code strings, and digital graphics.

  5. Unauthorized Activity: You acknowledge that any unauthorized, malicious, or exploitative use of this Platform and/or its Services may lead to civil action, immediate account termination, and/or criminal prosecution under applicable laws.

  6. Financial Consideration: You agree to pay us all stated charges, taxes, and shipping rates associated with availing the Services and completing product acquisitions.

  7. Prohibited Lawful Use: You agree not to use the Platform and/ or Services for any purpose that is unlawful, illegal, or forbidden by these Terms, or by Indian or local international laws that apply to your geographical location.

  8. External Linking Dynamics: You understand and acknowledge that this Website and the active Services may contain operational links to other third-party websites (such as payment processing dashboards). On accessing these links, you exit our perimeter and will be governed by the independent terms of use, privacy policies, and operational structures of those third-party environments.

  9. Enforceable Commercial Contract: You understand that upon initiating a checkout transaction for acquiring products, you are entering into a legally binding, enforceable, and fully localized contract with the Platform Owner.

  10. Global Presentment & Financial Clearing: Prices displayed to international users may be dynamically converted to local standard currencies (such as USD or EUR) via front-end geo-location interfaces to facilitate browsing comfort. You explicitly acknowledge that because the Platform Owner operates primarily within India, all final checkouts are securely cleared, processed, and settled through our integrated domestic payment gateways (including Razorpay and standalone PayPal networks) using the financial equivalent value of your transaction.

  11. Premium Custom Assembly & Shipping Restrictions: Every item in our streetwear collection features bespoke digital graphics and undergoes a meticulous custom on-demand assembly cycle requiring a processing window of 3 to 5 business days prior to courier handover. In full alignment with our operational shipping limitations, roKsho.inc maintains a strict non-shipping policy for specific territories. Orders containing delivery destinations directed to Bahrain, Kuwait, Oman, Qatar, Saudi Arabia, United Arab Emirates (UAE), Israel, Iran, or France will be automatically blocked, cancelled, and fully refunded.

  12. Indemnification Clause: You shall indemnify, defend, and hold harmless the Platform Owner, its affiliates, group companies (as applicable), and their respective officers, directors, agents, and employees from any third-party claim, demand, legal action, or penalty—including reasonable attorney's fees—imposed due to or arising out of your breach of these Terms of Use, our Privacy Policy, or your violation of any law, rule, regulation, or third-party intellectual property right.

  13. Force Majeure: Notwithstanding anything contained in these Terms of Use, neither party shall be held liable for any failure or delayed execution of an obligation if the core performance is disrupted or made impossible by a qualifying Force Majeure event (including natural disasters, state embargoes, systemic carrier blackouts, or global supply chain halts).

  14. Governing Law: These Terms of Use, along with any dispute, claim, or legal enforceability arising from them, shall be governed by, interpreted, and construed strictly in accordance with the laws of India.

  15. Exclusive Legal Jurisdiction: All disputes arising out of or in connection with these Terms shall be subject to the exclusive legal jurisdiction of the competent courts located within the state of our registered corporate operations in India.

  16. Legal Contact & Customer Communications: All administrative concerns, formal notices, or operational communications relating to these Terms must be communicated directly to our team using the official customer care channels provided on roksho.store.
